Emergency legislation to provide for the activation of suspended sentences is likely to be presented within two weeks after the relevant sections of the Criminal Justice Act 2006 were struck down.
The High Court last month found that the provisions are unconstitutional because they allow for significantly different treatment of people before the law in relation to their rights of appeal. Making final orders in the case, Mr Justice Michael Moriarty yesterday struck down sections 99.9 and 99.10 of the Act. Attorney General Máire Whelan failed in an application for the judge to stop short of striking down the law. Read More

€564,000 For Rally Fan Who Lost His Leg26/4/2016 A man whose leg was amputated after he was struck by a car taking part in an international rally event has secured €564,000 damages.
The award to Blaine Murphy was made after the Court of Appeal rejected as "perverse" a High Court judge's finding he was primarily liable. The appeal court increased by almost €364,000 the High Court's award of some €199,000 compensation to Mr Murphy, now aged 30, of Cashelmara, Knocknacarra, Galway. He had appealed the High Court's finding of 66.66pc contributory negligence against him, which had cut his award for injuries suffered as a 19-year-old spectator at the 2005 Galway International Motor Rally. He sued County Galway Motor Club Ltd, which organised and managed the rally under the auspices of Irish Motorsport Federation Ltd (Motor Sport Ireland), and Motor Sport Ireland Safety Team, which provided safety services for the rally. Nearly 34,000 new personal injury claims were submitted to the Injuries Board in 2015, representing a six per cent increase in new claims compared to 2014.
There were a total of 33,561 new personal injury claims in 2015 and the Government-run Board made 11,734 compensation awards, totalling €278.4 million in value. In 2014, the Board made 12,420 awards worth €281.2 million. Based on projections for 2016, the Injuries Board will make an average of 12,000 claims over the period 2014-16, compared to around 1,500 personal injury cases adjudicated in the courts per year. Figures published in the Board’s 2015 Annual Overview show that the average compensation award has remained consistent at €22,878 (up 1 per cent from €22,642 in 2014). The breakdown of awards also remained consistent, with motor liability accounting for 75 per cent of awards, employer liability for 8 per cent of awards, and public liability for 17 per cent of awards. Irishman Killed in Sydney Stabbing31/3/2016 An Irishman has died after being stabbed in Sydney, Australia.
Keith Collins, who lived in Terrigal, New South Wales, was attacked while dining with a woman in Hornsby Mall last night. The woman, Jobi Pilapil, was also stabbed during the incident. The 38-year-old was taken to hospital to receive treatment for her injuries. It is believed Mr Collins, 53, was from Dublin, but had been living in Australia for some time. Read More

The California District Attorney investigating last summer’s Berkeley tragedy will not be bringing any criminal charges in connection with the collapse of a balcony that killed six young people and injured seven others.
Nancy O'Malley said that following a nine-month investigation her office had concluded that there was “insufficient evidence” to bring criminal manslaughter charges against any one individual or company. On 16 June last year, an apartment balcony at the Library Gardens complex in Berkeley collapsed as young people celebrated a 21st birthday. Read More |
